STOCKS - ACTION ALERT -
Unfulfilled downside projections still point the Dow Industrials into the 9200-9700 range. That equates to approximately 10,500 in the TSX and 1000 to 1050 in the SPX. As I told you, it appeared we hit a trading bottom on Friday with potential to rally perhaps into President's Day weekend (February 12-15) followed by another decline. That decline should carry into March and we'll take it from there.
Early weakness yesterday was offset by strength in tech to allow the indices to claw their way back to a mixed close. For the session, the Dow was off 26.30 at 10270.55, the S&P 500 was off 6.04 at 1097.28, and the Nasdaq Composite was up .85 at 2190.91. Volume decreased from Tuesday and breadth was negative.
While we have left the possibility open that a rally could develop and gain steam between now and President's Day, yesterday's lack of follow through should be a concern for the bulls, as the major indices continue to trade under their 50 day moving averages.
Large cap tech (QQQQ) was yesterday's best performer, gaining 0.55%, while high yield bonds (HYG) gained 0.51%. Each was on declining volume though.
Consumer discretionary (XLY) gained 0.07%, thanks to a big gain at News Corp (NWSA +7.13%) after reporting solid earnings, rounding out the list of gainers.
The balance of market action was on the negative side as base metals (DBB -2.96%) saw above average volume selling, as did the Dow Transports (-1.39%).
Materials (XLB) lost 1.15% on dollar strength, while weakness in financials (XLF -1.10%) was brought about by a resurrection of concerns over bad mortgage loans.
Healthcare (XLV -1.34%) was the worst performing sector after President Obama encouraged Democrats to "finish the job" on overhauling the U.S. health-care system and financial reform.
All in all, this was not a good day for the market as there was more widespread weakness than the headline index numbers would have us believe.
AFTER HOURS NEWS:
Cisco Systems on Wednesday reported a profit of $1.85 billion, or 32 cents a share, compared with a profit of $1.5 billion, or 26 cents a share, for the year-earlier period. Revenue was $9.8 billion, up from $9.1 billion for the same quarter the previous year. Adjusted income was 40 cents a share. Analysts had expected the networking-gear giant to report earnings of 35 cents a share, on revenue of $9.4 billion. Cisco also reported cash and cash equivalents and investments totaling $39.6 billion at the end of the second quarter, compared with $35 billion at the end of fiscal 2009. For the current quarter, the company said it expects sales to grow 23% to 26% year-over-year, which translates to a range of roughly $10 billion to $10.3 billion. That's dramatically higher than the current estimate of $9.52 billion in sales. CSCO rallied 3.5% in after hours trading.
Visa Inc. reported a 75% jump in quarterly net income late Wednesday. The payment processing giant said fiscal first-quarter net income came in at $763 million, or $1.02 per class A common share. That compares to $574 million, or 74 cents per class A common share, a year earlier. Net operating revenue in the latest period was $2 billion, up 13% from the prior-year period. The company was expected to make 91 cents a share. Visa also said its 2010 annual operating profit margin will likely be in the mid- to high-50% range. Late last year, Visa said the margin would be in the mid-50% range through 2010. V rose 3.0% in after hours trading.
Higher margins and brisk sales overseas helped Yum Brands Inc., the owner of Taco Bell and KFC, push its fourth-quarter profit slightly higher, the company said Wednesday. Yum earned $216 million, or 45 cents a share, in the period, up from $204 million, or 43 cents a share, in the same quarter a year ago. Excluding items, the company said it would have earned 50 cents a share, up from 46 cents. Total revenue slipped 1% to $3.36 billion. The average estimate of analysts had been for Louisville, Ky.-based Yum to earn 48 cents a share on revenue of $3.3 billion. Looking ahead, the company said it expects to continue to increase profits even in what it called a "tough" macroeconomic environment. "In 2010, we once again expect to achieve our annual target of at least 10% EPS growth," said David Novak, chief executive, in the earnings report. "Our profitable international new unit development will be a key driver of our growth as we execute against our obvious short-term challenge of driving same-store-sales growth." YUM fell 1.7% in after hours.

DOW TRANSPORTS - ACTION ALERT -
I've been asking whether we will we get a bounce back to 4069-4100. Last Friday's low was 3886.37 and we touched 4022.48 on Tuesday(measured intra-day). Volume was positive. And, remember, I always view the Dow Transports as an excellent leading indicator for the market at large. Without volume confirmation I assume we're going to see lower prices with the next target being 3700.
Transportation stocks underperformed yesterday after Ryder Systems missed estimates and lowered expectation for 2010. The Dow Jones Transportation Average fell 55.31 or 1.39% to 3937.81.
Ryder Systems Inc. said Wednesday that fourth-quarter earnings were $8.2 million, or 15 cents a share, compared to $10.6 million, or 19 cents a share, in the year-ago period. Adjusted earnings per share were 43 cents versus 91 cents. Revenue was $1.25 billion compared to $1.34 billion. Analysts estimated, on average, earnings per share of 47 cents. For 2010, Ryder sees earnings per share in the range of $1.80 to $1.95. The average forecast was for earnings per share of $2.20. R declined 7.74%.

GOLD and METALS - ACTION ALERT -
I am not going to lulled into believing that Gold is dead and that we've experience a balloon. The balloon is yet to come, but when it comes it will be so dramatic that they will be talking about it on the street corners when the US Dollar is devalued possibly 50% from current levels. I just hope there is no blood in the streets. We're still in a 1070 to 1170 trading range and though there are theoretical technical measurements into the mid-900s, I am not acting upon in any way at this time.
Precious metals fell yesterday on dollar strength. Gold was down 4.10 to 1109.30, silver fell 0.33 to 16.37, platinum dropped 10 to 1569, and palladium lost 6 to 436. Copper hit a three month low yesterday and closed down 0.1160 at 2.9735.

BONDS - ACTION ALERT -
Treasuries fell sharply yesterday with yields back up to their highest levels in two weeks as the economy slowly improves and the market is still pricing in recent moves by the President, including a continued push for health care reform and a budget that includes huge spending and record setting deficits. The long bond future declined 1 1/32 to 117 12/32. Bonds are were acting independent of stocks yesterday and should have rallied or bonds are anticipating a further rally in stocks. An interesting divergence. Perhaps it does suggest more of a rally in stocks is ahead maybe into the President's Days weekend mentioned above. But, once stocks nosedive we should see a flight into saftey into the bonds and a decline in interest rates.
IEF was off 0.48% while TLT was off 1.16% on heavy volume.
Also hurting Treasuries yesterday, Moody's Investors Service said the top debt ratings on the U.S. and the U.K. may "test the Aaa boundaries" because public finances are worsening in the wake of the global financial crisis. "The deterioration has been pretty severe," said Pierre Cailleteau, managing director of sovereign risk at Moody's, in a Bloomberg Television interview in London. "We expect a pretty strong policy response in the next couple of years in order to keep the debt in the Aaa range. We expect them to bend but not to break." The U.S.'s debt burden will climb to 97.5 percent of gross domestic product next year from 87.4 percent, the Organization for Economic Cooperation and Development forecast in June. National debt in the U.S. climbed to $7.17 trillion in November. The U.K.'s public debt will swell to 89.3 percent of the economy in 2010 from 75.3 percent this year, according to the OECD.
The Treasury Department said it will sell $81 billion in debt next week. It will auction $40 billion in 3-year notes on Tuesday, followed by $25 billion in benchmark 10-year notes on Wednesday and $16 billion in 30-year bonds on Thursday.
The government also said it is considering more frequent sales of Treasury Inflation Protected Securities -- known as TIPS. One option is selling 10-year TIPS six times a year, instead of the four times as is done now.

CRUDE OIL - ACTION ALERT -
Crude Oil is tracking with the stock market and to a certain degree inversely with the US Dollar. So long as the current equity rally persists and the Dollar corrects look for a further rally try. I mentioned yesterday that I had my suspicions that Crude would go very far here.
Oil bounced around yesterday but finished the day down 0.25 to 76.98 after inventories rose, but not as much as some expected.
The EIA said crude oil inventories rose by 2.3 million barrels in the week ended January 29. Analysts polled by Platts expected a decline of 1 million barrels in crude stocks. But the American Petroleum Institute, a research group, had estimated on Tuesday an even larger increase in supplies of 4.7 million barrels. The EIA also said inventories of distillate, which includes heating oil, fell by 948,000 barrels, while gasoline stocks fell by 1.3 million barrels. Analysts polled by Platts expected a drop of 1.2 million barrels for distillates, and of 1.5 million barrels for gasoline stocks. Still, the EIA's data continued to reveal bearish trends for crude oil, including still high inventories and weak demand. Refinery utilization fell to 77.7%, while it was is expected to rise 0.25 of a percentage point to 78.75%.

US DOLLAR - ACTION ALERT -
Volume is to the upside and, as I've said, we have a good shot of seeing the lows 80s. The current is simply part and parcel to a normal 'zig-zag' pattern higher. Bigger picture, I still believe the Dollar is terminal and the uptrend we're now experiencing (which could last all year) is simply a 'dead-cat' bounce.
The US Dollar Index was up 0.398 to 79.412 as higher interest rates, stemming from an improving economy, boosted the attractiveness of the Dollar. The US Dollar Index hit a high of 79.457 yesterday, just shy of the recent six-month high of 79.534 set on Monday.
The European Union on Wednesday endorsed Greece's plan to cut its deficit from a level equal to nearly 13% of gross domestic product last year to 2.8% by 2012, just under the E.U.'s 3% limit. But the commission warned it would closely monitor the budget measures and a host of accompanying reforms.

The February Uranium Futures closed at $42.50. The current bear market low is $42.00. June 13, 2007 hosted the bull market high of 154.95. Major support lies well under the market at $36.00.
The spot price of uranium quadrupled from 2004 to 2007. When it hit $138/lb, uranium became a certified bubble, which has now burst. For investors, this is the best possible news, of course. Nuclear power is the ultimate alternative fuel, as the French will tell you. You get all the power, 84% cheaper than coal, with none of the politics of rogue nations and none of the greenhouse emissions.

ECONOMIC NEWS:
The service sectors of the U.S. economy rebounded in January, the Institute for Supply Management reported Wednesday. The ISM non-manufacturing index rose to 50.5% from 49.8% in December. Despite the improvement, the increase was below expectations. Economists were looking the index to rise to 51%. The index had been above 50 for two months in the fall but then slipped under the threshold in November and December. The closely-watched employment index rose to 44.6% in January from 43.6 in December. The employment index has been below 50 since December 2007. It hit a low of 31.1 in November 2008.
Private-sector firms in the U.S. eliminated 22,000 jobs in January, the 24th decline in a row, according to the ADP employment report released Wednesday. It was the fewest jobs lost since 22,000 jobs were added in January 2008. In December, a revised 61,000 jobs were lost, compared with the 84,000 originally reported, ADP said. The ADP jobs data come two days before the Bureau of Labor Statistics releases its estimate of January nonfarm payrolls. Economists are looking for payrolls to rise 20,000 in the BLS survey.
Planned layoff announcements at major U.S. corporations increased 59% in January, reaching 71,482 from a nine-year low of 45,094 seen in December, according to the latest job-cut tally by Challenger Gray & Christmas. It was the first month-to-month increase since July, the outplacement firm reported Wednesday. Layoff plans ran 70% lower than the 241,749 announced in January 2009, which was a seven-year high.
Democrats should "finish the job" on overhauling the U.S. health-care system and financial reform, President Barack Obama said Wednesday. Speaking to Senate Democrats, Obama also appealed to his party to put job creation plans into action "without delay." Obama also rapped Republicans for rejecting a commission that would study ways to shrink the federal deficit.
MarketWatch reports: "Just when they thought the worst of the mortgage crisis was behind them, billions of dollars in bad loans from the debacle may be rising from the dead and creeping back on the balance sheets of the largest U.S. banks. Big lenders including Bank of America, J.P. Morgan Chase and Wells Fargo may be forced to repurchase troubled home loans from insurers and mortgage-finance giants like Freddie Mac that had agreed to take on risks associated with those assets during the real estate boom. The banks are setting aside more reserves to cover the potential costs of such repurchases, cutting into earnings.."
Bloomberg reports: "The U.S. may lose 824,000 jobs when the government releases its annual revision to employment data on Feb. 5, showing the labor market was in worse shape during the recession than known at the time." CORPORATE NEWS:
Pfizer Inc. reported higher fourth-quarter earnings early Wednesday, with its top-line boosted by recent its merger with rival Wyeth as it benefited from the absence of a hefty year-ago charge related to its pain reliever Bextra. For the fourth quarter 2009, Pfizer posted net income of $767 million, or 10 cents a share, compared with $266 million, or 4 cents a share, for the same period in 2008. Excluding various charges, Pfizer would have reported adjusted earnings of 49 cents vs. 65 cents a share. Revenue rose 34% to $16.54 billion from $12.35 billion. Sales of Wyeth products contributed $3.3 billion to the top-line. Analysts pegged Pfizer at earning 50 cents a share, on revenue of $15.88 billion. Pfizer also issued its 2010 financial forecast. The drugmaker said its sees revenues coming in between $67 billion and $69 billion, and earnings of 95 cents a share to $1.10. Adjusted earnings are seen at $2.10 to $2.20 a share. For 2012, Pfizer said it is targeting achieving reve nue of $66 billion to $68.5 billion, and earnings of $1.58 to $1.73 a share. The company hopes to report adjusted earnings of $2.25 to $2.35 a share. PFE fell 2.31%.
MetLife Inc. said late Tuesday that fourth-quarter net income came in at $289 million, or 35 cents a share, down 70% from a year earlier when the life insurance and annuity giant made $954 million, or $1.20 a share. Operating earnings, which exclude net realized investment gains and losses, were $793 million, or 96 cents a share, in the latest period. The insurer was expected to make 95 cents a share. Premiums, fees and other revenues were $9.3 billion in the latest quarter, up 14% from the fourth quarter of 2008, MetLife said. The company also said it's in talks with American International Group about buying its subsidiary American Life Insurance Company (ALICO). "No agreement has been reached and there are no assurances that an agreement will be reached," MetLife added. MET dropped 4.32%.
Aflac Inc. said late Tuesday that fourth-quarter net income rose to $251 million, or 53 cents a share, from $197 million, or 42 cents a share a year ago. Including net realized investment gains and losses, the insurer made $558 million, or $1.18, compared with $458 million, or 98 cents a year ago. Aflac was expected to make $1.15 a share. AFL gained 2.49%.
News Corp. said late Tuesday that it swung to a second-quarter profit on strong performance in its film and cable TV businesses, as well as strength in the newspaper category. For the quarter ended Dec. 31, the media giant reported net income of $284 million, or 10 cents a share, compared with a net loss of $6.4 billion, or $2.45 per share, for the same period last year. The company said earnings on an adjusted basis would have been 25 cents a share for the recent quarter. Overall revenue grew 10% to $8.68 billion. Analysts were expecting earnings of 20 cents a share on revenue of $8.23 billion. The company also said that it raised its dividend by 25% to $0.075 per class A and class B share, payable on April 14. NWS rallied 6.05%.
The Black & Decker Corp. said Wednesday that fourth-quarter earnings were $34 million, or 55 cents a share, compared to $44 million, or 72 cents a share, in the same period a year ago. On an adjusted basis, Black & Decker's earnings per share were $1.24, excluding expenses related to the proposed merger with The Stanley Works. The tool maker sees "modest improvement this year." Analysts estimated, on average, earnings per share of 78 cents in the recent quarter. BDK rose 3.69%.
JDS Uniphase reported a fiscal second-quarter loss of $19.5 million, or 9 cents a share, compared with a loss of $722.9 million, or $3.36 a share, for the year-earlier period. Revenue was $342.9 million, down from $353.8 million for the same quarter the previous year. On an adjusted basis, the company posted earnings of 12 cents a share. Analysts had expected the company to report earnings of 9 cents a share, on revenue of $333.2 million. For the current quarter, the company said it expects adjusted revenue in the range of $325 million to $350 million. Analysts currently expect the company to post revenue of $316.5 million. JDSU jumped 4.06%.
VeriSign Inc. on Tuesday reported fourth-quarter net income of $92 million, or 48 cents a share, compared to a loss of $95.9 million, or 50 cents a share in the same period a year earlier. Revenue for the quarter ended Dec. 31 rose to $262.7 million from $248.8 million, the Mountain View, Calif.-based Internet infrastructure company said. Analysts had expected VeriSign to post earnings of 34 cents a share, and $260.8 million in revenue. VRSN declined 0.51%.
Tesoro Corp., citing depressed demand for transportation fuels, reported late Tuesday a fourth-quarter loss of $179 million, or $1.30 a share, reversing net earnings of $97 million, or 70 cents a share, a year ago. Included in the loss is $43 million in impairments from its Anacortes refinery in Washington. Revenue rose 10% to $4.67 billion from $4.24 billion. The company said it will suspend its quarterly dividend "for the foreseeable future" to preserve cash. Analysts estimated the company would post a loss of 70 cents a share on $4.71 billion in revenue. Shares of the San Antonio, Texas, oil refiner rose 15 cents to close at $12.98 ahead of the report. The stock is down 20% over the past 12 months. TSO lost 5.55%.
Media conglomerate Time Warner Inc. swung to a fourth-quarter profit, reporting Wednesday financial results that showed strong performances for its filmed-entertainment and cable-networks divisions as well as the absence of special charges. The New York-based company also increased its dividend and stock-buyback plan as CEO Jeff Bewkes said Time Warner achieved all goals set forth for 2009. In its first earnings statement since spinning off AOL in December, Time Warner said it earned $627 million, or 53 cents a share, in the fourth quarter of 2009. Excluding various items, Time Warner said it would have earned 55 cents a share for the latest quarter, up from 19 cents in the year-earlier period. Quarterly revenue rose to $7.32 billion from the prior year's $7.16 billion. Analysts had, on average, been expecting a profit of 52 cents a share on revenue of $7.14 billion. For 2010, Time Warner expects growth in adjusted earnings from continuing operations at a "mid-teens" rate com pared to 2009's $1.83 a share. Analysts' consensus stands at $2.13 a share. The company's board approved raising the quarterly dividend by 13.3% to 21.25 cents a share, and last week it extended Time Warner's authority to make stock repurchases to $3 billion from $1 billion. TWX slipped 2.14%.
