I wonder if your attorney can point to any examples in real life any one being sued (and not having the case immediately dismissed) as a function of reporting what they are doing on a web site.
I don't think even penny-stock pump and dumpers get sued very often. I might add that someone had better have some real firepower if they think they are going to get private information from us about our users.
a) this site is fully disclaimed.
this site is aggressively policed by us and our volunteers for possible wrong doing, including even unethical (but not illegal) behavior.
c) this site is a de-facto publication--there is not personalized advice, thus there's likely an affirmative defense on those grounds (though some legal or better 1st amendment scholar could tell us better). How often do you hear about the Wall St. Journal or IBD being sued because something they wrote about went down?
I would suspect that your attorney wants to look like he's earning his money, but he's not being realistic. He'd do better to counsel you to stay out of your car and not have guests over for cocktails.
But it's your heinie on the line.

Yesterday was the 6th distribution day for Nasdaq Composit. For me the sell signal in trading account.
Sold all DIA's & SPY's about 20 minuets ago.
Sold DIA's for a profit of 0.84% since buy last month. Also collected .38 cents per share in dividends while holding position.
Sold 1st buy of SPY's for a profit of 6.45%.
Sold 2nd buy of SPY's for a profit of 6.83%
Had a profit of 4.81% on QQQQ's I sold to buy the DIA's. All were part of this buy signal.
Moving total proceeds to SHY's(1-3 year treasury ETF) until next buy signal. Have no idea when that will be.
I regret I am going to have to stop posting these trades here in real time. My attorney's orders. No point in having a dog and barking myself. Guess it is just the way the world is. Good trading everyone.

Mark,
I understand as I also had to start being very vague about trades and how I suggested stocks.
Too bad, but keep posting ideas etc. knowledge is powerful. Thanks for all your postings.

It may have to do with any other jobs or duties he is involved in. Such as sitting on the Board of certain companies or organizations. Also under some conditions as a Trustee or advisor to Trusts of varying sorts.
Someone might/could claim conflict of interest etc. The world today is far different today.
