--------------------------------------------
Current TIMER DIGEST Signals:
Stocks - Bull -
We started a see a little bounce yesterday which usually occurs during Options Expiration week, but it was sure anemic. It appears the market has topped out short-term and is in a corrective phase that in the worst cast could retest the March lows. Yesterday, I provided you some Fibonacci related pullback levels, the worst being at 1284 in the S&P 500. On the other hand, we could hold here around the 1309 level. I am awaiting the posting of upside volume, hopefully broad-based Leibovit Positive Volume Reversals to confirm a low. The news environment is negative and from a contrarian's viewpoint this is bullish. We are fearful of a Marxist President Obama, the implications of Japan's nuclear accident, the fear of further protests and conflict in the Mideast and North Africa, the fear the 'B52' Ben Bernanke will not proceed with a QE3 program, the fear that interest rates will rise and the fear that rising Crude Oil prices will squash any hope of a economic recovery. One would think the market is already trading at the March, 2009 lows with this formidable series of events now transpiring, but it is not! I am a little cautious due that formation of some Leibovit Negative Volume Reversals last week, but things can also change quickly to the positive. My overall view? We are experiencing a pullback ahead of another surge to new highs! We will all know in the fullness of time, won't we?
Gold - Bull - I remain bullish and only see the formation of a trading top, not an intermediate top. I would be little concerned if we take out 1443.50 in Spot Gold and 39.72 in Spot Silver, that we may be experiencing a deeper correction, but currently holding positions on the bet that we come out of this to the upside. And see Gold near 1500 (if not higher) and Silver in the low to mid 40s. Stay tuned, especially Platinum subscribers looking for a trading exit and/or entry intra-day.
Bonds - Bearish - On the sidelines awaiting an opportunity to position on the short (inverse index) side.

STOCKS - ACTION ALERT -
The stock market finished nearly unchanged after some mixed earnings and economic reports. But there was a lot of sector action to talk about. The Dow Industrials was up just 7.41 or 0.06% to 12270.99 after trading up as much as 72 point earlier in the session. The S&P gained only 0.25 or 0.02% to 1314.41. The NASDAQ, thought, jumped 16.73 or 0.61% to 2761.52.
The commodity sectors finished mixed with Materials down (XLB -0.59%) as copper prices declined but Energy up (XLE +0.41%) as oil prices rose.
On the earnings front, Technology stocks did well (XLK +0.62%) after the networking-storage firm, Riverbed Technology, raised its earnings forecast. But Financials were the worst performers (XLF -0.75%) after the market was disappointed with JP Morgan's earnings.
As you know, I'm sitting on the sidelines here after recently taking profits on our index ETF position. The market held steady yesterday, so I'm happy to just be sitting aside and watching for now.
-------------------------------------------
DOW TRANSPORTS - ACTION ALERT -
Transportation stocks underperformed yesterday and Airlines fell sharply as oil prices rose. The Dow Jones Transportation Average slipped 7.10 or 0.14% to 5232.38.
The AMEX Airline Index dropped 1.20% after Orbitz Worldwide said that American Airlines parent AMR Corp. has filed a lawsuit against the company and its prime stakeholder Travelport in relation to a recent dustup over fees and how the carrier's fare information and services would be displayed to customers. AMR fell 2.03% and OWW fell 3.13%.
--------------------------------------------
GOLD and METALS - ACTION ALERT -
Precious metals recovered some of their recent losses as the group continues to follow in the same direction as oil prices. Gold rose 3.70 to 1457.40, silver gained 0.55 to 40.66, platinum inched up 2 to 1773, and palladium was up 3 to 763, whereas copper fell 0.0890 to 4.2945.
Gold is likely to break through $1,600 an ounce before the end of the year as investors continue to be concerned about inflation and loose monetary policy, metals consultancy GFMS said Wednesday. Investment demand for gold fell in 2010, however, but was still "comfortably" the second highest on record, GFMS said. Jewelry demand partly recovered in 2010, as there were signs the gold market has adjusted to the higher prices. Scrap supply was little changed from 2009 despite gold's gains in 2010. In the official sector, central banks became net buyers of gold in 2010, the first time since 1988. Mine supply gained last year, with all major gold-producing regions contributing to 2010's higher totals, the first time since 1988, GFMS said.

URANIUM - ACTION ALERT
Uranium is sitting quietly at $59.00 after seeing $73.00 B.J. (Before Japan). Overall, its' been a roller-coaster ride. Uranium swings from the June 13, 2007 high of 154.95 down to 40.00 and recently back up to 73.00 until the Japanese earthquake. We then nosedived to 52.00 and have recovered back to 62.50. Now, we're at $59.00 (or $58.50 Spot as quoted below). Nothing has changed regarding the need for nuclear power. It is truly the only long-term solution to the world's growing energy needs. When Chancellor Angela Merkel of Germany suddenly turned negative on nuclear power (more like to gain votes), she did not take into account that without it German would be at the mercy of Russia's natural gas and Middle East oil. I know France doesn't want to put itself in that position. Airplanes often crash, but do we stop flying? When the lights go off in America and France, China, India, Iran and other former third world countries are basking in energy, opinion will change really fa st, but will it be too late? If nuclear battleships and subs can run in the high seas for years without refueling, imagine what could be done with industrial plants, automobiles, and home energy supplies. The vision we saw in the great movie 'Back to the Future' is within our grasp, but greed and fear are in our path. Stop burning fossil fuels

BONDS - ACTION ALERT-
Treasuries rallied after the Federal Reserve's Beige Book said that even though the economy was slowly improving, Japan's earthquake and tsunami are causing unexpected disruptions. The long bond future rose 15/32 to 119 26/32.
The Federal Reserve Bank of New York bought $5.01 billion in Treasury debt on Wednesday as part of a program that is the centerpiece of the Fed's loose monetary policy. Dealers offered the Fed $42.89 billion in debt maturing from 2012 through 2013.
The Treasury Department sold $21 billion in 10-year notes on Wednesday at a yield of 3.494%, a little higher than traders expected. Bidders offered to buy 3.13 times the amount of debt sold, in line with the average at the last four comparable sales. Indirect bidders, a group which includes foreign central banks, bought 42.4%, the lowest since October and versus a recent average of 48.1%. Direct bidders -- which include domestic money managers -- purchased another 5.9%, compared to 9.2% on average.
--------------------------------------------
CRUDE OIL - ACTION ALERT -
Oil moved higher yesterday after inventories fell more than expected. Crude oil gained 0.86 to 107.11. We have clear hit a trading top, but there are still unfulfilled higher projections, so I am giving Crude Oil the bullish benefit of the doubt and holding a long Crude Oil related ETF position at this time.
The Energy Information Administration said U.S. supplies of crude increased 1.6 million barrels in the week ended April 8, as analysts polled by Platts expected. The EIA reported a decrease for gasoline inventories of 7 million barrels. Distillates supplies decreased 2.7 million barrels. Both figures showed deeper declines than forecast. Analysts expected a decrease of 1.3 million for gasoline and unchanged stocks of distillates.
Late Tuesday, the American Petroleum Institute reported crude-oil inventories increased by 1.2 million barrels in the week to April 8. API also reported a decline of 4.6 million barrels for gasoline stockpiles, and a decline by 3.7 million barrels for distillates inventories.
--------------------------------------------
US DOLLAR - ACTION ALERT -
The US Dollar Index recovered ever so slightly yesterday but is staying near its 16-month low. The US Dollar Index inched up 0.127 to 74.980, just above the 74.704 low set Tuesday.
Platinum subscribers know we've been short via an inverse ETF in the U.S. Dollar Index.
Industrial production in the euro zone rose 0.4% in February, the European Union statistics agency Eurostat reported Wednesday. Compared to the same month last year, production grew by 7.3%. Economists had forecast a 0.8% monthly rise and a 7.9% year-on-year increase.
The Euro fell 0.24% against the Dollar.
The number of British workers claiming jobless benefits rose by a seasonally-adjusted 700 in March to 1,450,500, the Office for National Statistics reported Wednesday. Economists had forecast a decline of 5,000. Persons claiming benefits accounted for 4.5% of the workforce, unchanged from February and in line with forecasts. The unemployment rate in the December-February period fell to 7.8% from 7.9% in the previous three months. The total number of unemployed decline by 17,000 over the quarter to 2.48 million, the ONS said. Average earnings, excluding bonuses, saw a 2.2% annual rise in the December-February period, matching forecasts.
The Pound rose 0.06% against the Dollar and 0.31% against the Euro.
A senior government economist said China is on track to raise interest rates twice more in the current quarter, as it sharpens its policy on combating inflation, according to a report late Wednesday by the official Xinhua News Agency. The report cited Fan Jianping, head of the economic forecast department at the State Information Center, as saying he expects two additional rate hikes by the end of the first half, followed by a more stable period in terms of policy adjustments. Fan reportedly said China faces a near impossible task of keeping consumer-price inflation (CPI) below 4% for the year. Data showed that CPI rose 4.9% in February from a year earlier, while figures due out next week are expected to show the March CPI above 5%, the report said. China's central bank lifted lending and deposit rates in a quarter-percentage point move last week, the second tightening of its main policy rate this year.
The Yuan dropped 0.02% against the Dollar.
Chile's monetary policy makers late Tuesday lifted the country's key interest rate by a half percentage point to 4.5%, meeting market expectations. The central bank said in a statement that inflation has increased globally and that elevated prices for crude oil have lifted inflation expectations in the private sector. The key rate was also lifted by a half percentage point in March.
The Chilean Peso tumbled 0.60% against the Dollar.
--------------------------------------------
ECONOMIC NEWS:
Sales at U.S. retailers increased 0.4% in March to a seasonally adjusted $396.3 billion, the Commerce Department estimated Wednesday. This is the ninth straight increase in retail sales but the smallest gain since the string started last July. Sales rose an upwardly revised 1.1% in February. Details of the March report were weak as much of the sales gain came from by higher gasoline prices. Excluding gasoline, retail sales rose 0.1% in March. Ahead of the report, economists expected total sales to rise 0.5% in March. Excluding the 1.7% drop in motor vehicle sales, retail sales rose 0.8%. Economists had expected a 0.7% increase. Core sales, excluding autos, gasoline and building materials, rose 0.4% in March after a 1.1% gain in Feb.
Inventories at U.S. businesses rose a seasonally adjusted 0.5% in February, the Commerce Department said Wednesday. Economists had been expecting inventories to rise 0.7%, compared to a revised 1.0% gain in January. Meanwhile, business sales rose 0.2%, compared to an increase of 2.0% in January. The inventory-to-sales ratio, an indication of demand, was flat at 1.24 in February.
The Japanese earthquake may be having more of an impact on the U.S. economy than previously believed, according to the Federal Reserve's latest Beige Book survey of current economic conditions released on Wednesday. A majority of the Fed's 12 regional districts reported "actual or expected disruptions to sales and production" as a result of the Japan earthquake. Overall, the Beige Book found that activity generally continued to improve since early March although some districts reported only moderate gains while others were more upbeat. The report found that more businesses were trying to pass along higher costs to consumers but were having mixed success.

CORPORATE NEWS:
J.P. Morgan Chase said its first-quarter net income rose to $5.56 billion, or $1.28 a share, from $3.33 billion, or 74 cents a share, in the year-ago period. Revenue fell to $25.79 billion from $28.17 billion, in the year-ago period. Wall Street analysts expected the investment bank to earn $1.15 a share, on revenue of $25.21 billion. J.P. Morgan Chase also increased its quarterly dividend to 25 cents a share from 5 cents a share. The company also set plans to buy back $8 billion in stock this year as part of a $15 billion stock buyback program. JPM fell 0.84%.
Riverbed Technology estimated first-quarter adjusted earnings and revenue above previously announced forecasts. Riverbed said it expects first-quarter adjusted earnings of 19 cents to 20 cents a share on revenue of $163 million to $164 million. Analysts estimate first-quarter earnings of 18 cents a share on revenue of $161 million. RVBD jumped 12.35%.
--------------------------------------------
POST-MARKET NEWS:
Compuware issued an earnings warning for its fiscal fourth quarter. Compuware said it expects to earn between 13 cents and 15 cents a share, while Wall Street analysts had forecast the company to earn 18 cents a share. Compuware said its results were impacted by two contracts that had to be pushed out from the quarter. CPWR fell 6.0% in after hours.
Zipcar Inc. priced its initial public offering late Wednesday at $18 -- above the previously expected range of $14-$16. About 9.68 million shares were sold in the offering. Zipcar operates a car-sharing service in 14 cities and more than 230 college campuses across the U.S. and U.K. The stock will begin trading Thursday on the Nasdaq Global Market under the ticker symbol "ZIP." Goldman Sachs and J.P. Morgan led the underwriting of the deal.
