Commentary below from Mark Leibovit, TIMER DIGEST's #1 Intermediate Market Timer for the 10-year period ending in 2007 AND the #2 Intermediate Market Timer for the 10-year period ending in 2009.
--------------------------------------------
Current TIMER DIGEST Signals:
Stocks - Bull - Remain on 'Buy' signal, but looking for a pullback to establish new positions.
Gold - Bull - Gold and Silver at resistance, but a breakout could send Gold to next the 1390s and in Silver up to the 29.90s. Seasonality factors positive for Gold and Silver for part or all of February, but then we could experience weakness based on 'seasonality'. Copper remains the standout pushing to new highs and Palladium and Platinum not doing bad either. Uranium sitting a recovery highs, so keep alert there too!
Bonds - Neutral - Technicals call for a continuing Bear, that is, higher interest rates. Should equities experience a sharp correction in the first quarter, a bond rally should afford us an opportunity to play the short-side (inverse ETFs).

STOCKS - ACTION ALERT -
Folks, I received the following two emails, one from a market analyst and one from
a subscriber. The market analyst said "Subject: possible waterfall drop in world stock market - I had a major turn for February 2 to 4 - best of trades 200 % short!"
The subscriber sent me an email which was a solicitation he had received via email: "Urgent video: U.S. market collapse now unavoidable? He correctly forecast the market collapse of 2008 - and the sudden drops in January, February and May of 2010 and now he is issuing an urgent warning.... the sudden drops in January, February and May of 2010 --and now he is issuing an urgent warning...U.S. Stock Collapse is Inevitable: You Must Take Action Now to Protect Yourself. New video explains why a collapse may be imminent...and what you can do about it right now! The analyst, herein
unnamed claims that the Hulbert Financial Digest has ranked him second best out of a 145 services tracked in terms of risk-adjusted returns.
All of this is called the 'Wall of Worry' a term not necessarily invented but made famous by Joseph Granville.
Yes, we're going to get a market correction and even I have been warning that we could get a shakeout in the first quarter, but I also said it would come from new highs, likely over 1300, when other analysts were thinking it was going to happen at much lower levels.
Investors need to stay long. Traders, well, traders will have to wait until we get a clear sell signal. With Nasdaq leading the way and the Dow Transports under performing (possibly related to the current negative weather patterns), we are clearly getting some mixed readings. However, most indexes are pushing slowly and steadily higher. The best strategy for traders is to wait for pullbacks in both individual issues and the stock indexes, but keeping a core long position so you don't miss the action!
Stocks managed a small gain on Friday after unemployment fell to its lowest level since April 2009, though the number of jobs created was less than expected. But in the end, it has been the generally good earnings reports (see below) and the number of companies hiking their dividend or buying back stock (see Transports section below) that is boosting the market. The Dow rose 29.89 or 0.25% to 12092.15, the S&P gained 3.77 or 0.29% to 1310.87, the NASDAQ advanced 15.42 or 0.56% to 2769.30, and the Russell 2000 rallied 1.48 or 0.19% to 800.11. Volume was light and breadth was mixed.
Even with Friday's small gain, new recovery highs were set in the NASDAQ Composite, Dow Industrials, and S&P 500. However, the Dow Transports and Russell 2000 are still below their highs as those two groups continue to underperform. Among sectors, only two of the nine (XLB, XLK) posted new highs.
Of the 308 companies in the S&P 500 that have reported fourth-quarter results, 72% have topped analysts' expectations.
Bucking the uptrend were Utilities (XLU -0.61%) as harsh weather caused power outages and Energy (XLE -0.26%) after oil prices fell on Friday.
With more new highs in the indexes, the market is clearly trending up. And with continued concerns over Egypt and the European debt crisis, we are clearly climbing the Wall of Worry. I remain on a TIMER DIGEST Buy Signal, as I've been throughout this advance.
-------------------------------------------
DOW TRANSPORTS - ACTION ALERT -
Transportation stocks underperformed as the bad weather continued to disrupt travel on Friday. The Dow Jones Transportation Average rose 8.32 or 0.16% to 5055.67. While other indexes hit new high yesterday, the Dow Transports is still below its 50-day moving average. This is worrisome, but not a reason to panic.
Airlines fell on Friday (^XAL -0.76%) as flight cancellations this week approached 20,000 on Friday following sever winter weather that stranded an estimated 700,000 to 800,000 fliers, according to FlightAware. At last check, total cancellations this week were 19,841, which includes 1,676 on Friday. American and Eagle airlines, units of Ft. Worth, Texas-based AMR, saw a combined 4,994 cancellations. Its neighbor, Dallas-based Southwest, was forced to cancel 2,286 flights. Dallas-Ft. Worth International Airport was forced to close earlier in the week because of snowy weather that stretched from Texas to Chicago and into New England.
Companies are telling us by their actions that underlying earnings are strong:
UPS said its board hiked the quarterly dividend by 11% to 52 cents a share from 47 cents. The dividend will be paid March 2 to shareholders of record on Feb. 14. UPS inched up 0.07%.
Union Pacific said its board approved a plan for the company to repurchase up to 40 million common shares by March 2014. If completed, the buyback would represent 8% of the company's current shares outstanding. The railroad operator also maintained its quarterly dividend of 38 cents a share. The next payment will be made April 1 to shareholders of record Feb. 28. UNP rose 0.69%.
--------------------------------------------
GOLD and METALS - ACTION ALERT -
Metals finished Friday mixed as uncertainty in Egypt continued to mess with the market. In the end, gold fell while silver and copper rose as the Dollar rallied and traders bet on an improving economy and that the situation in Egypt will be resolved with little effect on the international market. Gold declined 7.00 to 1348.60. Silver rose 0.19 to 29.14. Platinum gained 6 to 1843 and hit a 30-month high of 1867. Palladium slipped 6 to 812 after trading up to 838, a 10-year high. Copper hit a record high of 4.6140 and finished up 0.0350 at 4.5795.

URANIUM - ACTION ALERT
Watch Uranium! It's been creeping higher, now up $32.00 off its low! New highs at $73.00.
Ux U3O8 Prices* (Uranium)
January 31, 2010 Posting
Spot: $73.00 UP 3.00. Bull market high in the cash market was $138.00.
The January Uranium Futures closed at $73.00. A NEW RECOVERY HIGH. Uranium futures bear market was 40.00 following the June 13, 2007 the bull market high of 154.95. Major support lies well under the market at $36.00.
The spot price of uranium quadrupled from 2004 to 2007. When it hit $138/lb, uranium became a certified bubble, which has now burst.
--------------------------------------------
BONDS - ACTION ALERT-
Treasuries fell sharply Friday and interest rates hit their levels in months after unemployment fell to its lowest level in nearly two years. The long bond future declined 1 7/32 to 117 28/32.
Yields on 10-year notes rose 16 basis points to 3.65%, up from 3.57% before the report's release. It's the biggest one-day increase in yields since December. The benchmark's yield touched 3.67%, the highest level since early May.
Thirty-year-bond yields increased 11 basis points to 4.74%. They hit 4.75%, the highest since mid-April.
Yields on 2-year notes added 9 basis points to 0.76%, having briefly spiked to 0.78% - the highest since mid-June.
The Federal Reserve Bank of New York bought $7.272 billion in short-term debt on Friday, continuing its policy known as quantitative easing to keep interest rates from rising too much and impeding an economic recovery. Dealers offered to sell the Fed $28.809 billion in 2013-2015 debt. The Fed had purchased $371 billion in U.S. debt since August, when it started reinvesting cash from its maturing mortgage-related holdings into Treasury securities.
--------------------------------------------
CRUDE OIL - ACTION ALERT -
Oil was pressured on Friday by a strong Dollar, expectations that Egyptian President Hosni Mubarak may resign, and the realization that the blizzard in the United States and the turmoil in Egypt had little effect on either supply or demand. Crude oil declined 1.51 to 89.03. Resistance at 93.01 is now formidable and the burden of proof weighs heavily on the bulls. Downside target is now 83.00. Above 93.02, which apparently comes at a later time, we could see 100-105.
--------------------------------------------
US DOLLAR - ACTION ALERT -
The US Dollar Index rallied on Friday as traders focused on the positive side of the employment report and as European leaders met in an attempt to solve the debt crisis. The US Dollar Index rose 0.227 to 78.044.. A Positive Leibovit Volume Reversal was formed on Thursday, so Wednesday's low of 76.881 becomes important I previously mentioned that 78.65 was resistance. Let's see if we can breakthrough or whether that level holds. Has an important trading low formed or is this rally just another 'dead-cat' bounce.
European leaders agreed Friday to complete a package of reforms that will revamp the euro-zone rescue fund and impose tougher fiscal rules on nations using the single currency in an effort to end the region's long-running debt crisis. The leaders hope to strike what they dubbed a "grand bargain" by the end of March. Such an accord would see Germany agree to an increase in the lending capacity of the European Financial Stability Facility. In return, Germany would extract commitments for increased fiscal coordination, budget discipline and measures to boost competitiveness across the euro zone.
The Euro fell 0.34% against the Dollar.
British house prices rebounded 0.8% in January after a 1.1% decline in December, mortgage lender Halifax reported Friday. Compared to January 2010, the average house price was down 2.4% to 164,173 pounds ($264,926). Over the three months ending in January, house prices fell 0.7%.
The Pound declined 0.27% against the Dollar but rose 0.10% against the Euro.
The Treasury Department on Friday refused again to label China a currency manipulator but stressed that it will continue to press China to allow its currency to strengthen. One factor in the decision were commitments made by Chinese President Hu Jintao during his visit to Washington last month to enhance exchange rate flexibility and expand domestic demand, the department said.
The Yuan was unchanged against the Dollar.
--------------------------------------------
ECONOMIC NEWS:
The U.S. unemployment rate fell unexpectedly to 9.0% in January, a 21-month low, as nonfarm payrolls rose by just 36,000, the Labor Department estimated Friday. The 36,000 increase in jobs was much lower than market expectations of a 140,000 gain. Economists had expected the jobless rate to tick higher to 9.5% vs. 9.4% in December. The payroll growth was hampered by winter weather and annual benchmark revisions. But the labor market is improving. Since the recent low point last February, nonfarm payroll employment has increased by 1 million.

CORPORATE NEWS:
Tyson Foods said its first-quarter profit rose to $298 million, or 78 cents a share, from $160 million, or 42 cents a share, in the year-ago period. Excluding a one-time gain of 3 cents a share, Tyson earned 75 cents a share, in the latest period. Sales increased to $7.62 billion from $6.64 billion. Wall Street analysts expected Tyson to earn 62 cents a share on revenue of $7.17 billion. The meat producer said its chicken, beef and pork segments produced operating income in or above their normalized ranges during the quarter. Looking ahead at 2011, Tyson said it expects challenges, but the balance of the year has the "potential to be comparable" to 2010. Operating margin during the fourth quarter rose to 6.9% from 3.2%. TSN rose 5.69%.
Brisk business in Macau, along with a new casino in Singapore and lower interest rates helped Las Vegas Sands turn back solidly to profit in the fourth quarter, the casino giant said Thursday. Sands earned $270 million, or 34 cents a share, on the period, vs. a loss of $114 million, or 17 cents a share, in the same period a year ago. On an adjusted basis, the company said it would have earned 42 cents a share. Revenue ballooned 56.9% to a record $2.02 billion. Analysts had been for the company to earn 38 cents a share on revenue of $2.05 billion. LVS fell 8.45%.
Simon Property Group reported fourth-quarter net income of $217.9 million, or 74 cents a share, up from $91.5 million, or 32 cents a share, in the same quarter of 2009. The company said funds from operations was $1.78 a share, compared with $1.40 in the year-ago period. For 2011, the real estate investment trust forecast FFO in the range of $6.45 to $6.60 a share. SPG declined 1.17%.
U.S. insurer Aetna reported fourth-quarter net income rose to $215.6 million against $165.9 million in the year-ago period. On a per share basis, the company earned 53 cents against 38 cents, which included 10 cents per share of net realized capital gains. Operating earnings were 63 cents against 40 cents, which Aetna said was largely due to higher commercial underwriting margins and a reduced number of shares outstanding. Revenue slipped to $8.54 billion against $8.76 billion in the year-ago period. Analysts were calling for Aetna to earn 62 cents on revenue of $8.32 billion. The company declared a quarterly dividend of 15 cents a share and Aetna projects full-year 2011 operating earnings per share of $3.70 to $3.80. AET rallied 12.47%.
Weyerhaeuser said that it swung to a fourth-quarter net profit of $171 million from a loss of $175 million a year earlier. Earnings per shares in the quarter were 32 cents, compared to a loss of 83 cents a share a year earlier. The number of shares outstanding more than doubled in the intervening period due to the payment of a special dividend. Revenue for the quarter rose 14% to $1.66 billion. Weyerhaeuser said that, excluding one-off gains of $119 million in the latest quarter, it earned 10 cents a share. Analysts had been expecting earnings of 5 cents a share on sales of $1.55 billion. The forest products company said it has sold 82,000 acres of timberlands in southwestern Washington to the Hancock Timber Resource Group, for around $200 million. The deal will contribute around $150 million to its first-quarter earnings. WY gained 3.05%.
PulteGroup reported a fourth-quarter loss of $165.4 million, or 44 cents a share, compared with a loss of $116.9 million, or 31 cents a share, in the year-earlier period. The latest quarter included charges totaling $196 million. Consolidated revenue dropped to $1.2 billion from $1.7 billion, the home builder said. PHM was unchanged.
AmerisourceBergen, the pharmaceutical-services provider, reported fiscal first-quarter net income rose 6.1% on 2.9% higher revenue. For the quarter ended Dec. 31, earnings reached $160.5 million, or 57 cents a share, from $151.3 million, or 52 cents, in the year-earlier period. Shares outstanding fell 3.6% to 280.7 million. Revenue climbed to $19.89 billion from $19.34 billion. Analysts expected profit of 54 cents a share on revenue of $19.89 billion. For fiscal 2011, AmerisourceBergen expects to earn $2.31 to $2.41 a share. Estimates were for $2.38. Revenue should grow 2% to 4% from fiscal 2010's $77.95 billion, the company estimated. ABC gained 3.31%.
Clorox said its second-quarter profit fell to $21 million, or 15 cents a share, from $110 million, or 77 cents a share, in the year-ago period. Clorox booked a $258 million impairment for the impact of goodwill in the latest quarter. In the latest quarter, it reported a loss of $163 million in continuing operations, and a $177 million gain on the sale of its auto businesses. Breaking out the goodwill impairment and other items, Clorox said its adjusted earnings rose to 68 cents a share, from 66 cents a share. Revenue fell to $1.18 billion, from $1.22 billion. Wall Street analysts expected Clorox to earn 46 cents a share, on revenue of $1.19 billion. Clorox sees 2011 earnings of $3.85 to $4.00 a share, compared to the Wall Street target of $3.99 a share. Clorox said volume declined 2% primarily due to a comparison against high year-ago shipments of Clorox disinfecting wipes and other disinfecting products resulting from the H1N1 flu pandemic last year. CLX was up 3.31%.
JDS Uniphase reported fiscal second-quarter net income of $23.6 million, or 10 cents a share, compared with a loss of $19.5 million, or 9 cents a share, for the year-earlier period. Revenue was $473.5 million, up from $342.9 million. Adjusted income was 29 cents a share. Analysts had expected the company to report earnings of 19 cents a share, on revenue of $438.4 million. JDSU jumped 26.92%.
Coinstar predicted earnings per share for the first quarter that were below what Wall Street expected. The company also reported fourth-quarter results that were in line with an earlier pre-announcement. Earnings more than tripled, but came in below previous estimates because of a late-quarter slowdown in the company's Redbox DVD rental business. For the first quarter, Coinstar predicted that earnings would come in the range of 15-25 cents a share; analysts were expecting 57 cents a share. CSTR declined 11.93%.
--------------------------------------------
POST-MARKET NEWS:
Bank of America said it's exiting the reverse-mortgage business so it can focus more on its main mortgage operations. "We made the strategic decision to exit the reverse business due to competing demands and priorities that require investments and resources be focused on other key areas of our business," said Doug Jones, consumer sales and institutional mortgage services executive for Bank of America Home Loans, in a statement. BAC rose 2.2% in late trading.

Canadian TSX, TSX Venture and Canadian Dollar Commentary for our Canadian clients updated for Monday, February 7:
Lower oil prices dragged down the Canadian market even as copper rallied to a record high. The strong Canadian currency, thanks to a good employment report, also weighed on Canadian stocks. After an eight-day consecutive advance to new highs (touching 13,863.13 on Friday), the TSX declined 49.50 or 0.36% to 13791.85. Energy stocks fell 1.45%. My overall (current) upside target for the TSX is 14,715 in coming months.
Canada's job creation in January was more than four times the median forecast, pushing the Canadian dollar to its strongest level since May 2008 and adding to evidence the country's economic recovery may be accelerating. Employment rose by 69,200 and the labor force increased by 106,400, Statistics Canada said today in Ottawa. The jobless rate rose to 7.8 percent from December's 7.6 percent, as more people sought work. Economists forecast 7.6 percent unemployment and job growth of 15,000.
Research In Motion Ltd. gained 1.4 percent after the BlackBerry maker received an "outperform" rating from National Bank of Canada and Morgan Stanley said the company will beat estimates when it reports fourth-quarter earnings on March 24..
Aecon Group Inc. fell 11 percent, the most in the S&P/TSX, to C$8.78 after the construction and infrastructure-development company said it will record "significant losses" on an oil- sands project. Aecon said the losses should be limited to fiscal 2010, and will not affect its 2011 financial results.
Grande Cache Coal Corp., which mines in Alberta, declined 5.5 percent to C$10.12. Potash Corp. of Saskatchewan Inc., the world's biggest fertilizer producer by market value, fell 0.9 percent to C$179.16.
