STOCKS - ACTION ALERT -

A hesitant start for stocks yesterday after a disappointing jobless claims report and worries about protests in the Middle East and inflation here at home gave way to gains to new highs after a better than expected Philadelphia Fed survey. The Dow Industrials rose 29.97 or 0.24% to 12318.14, the S&P 500 gained 4.11 or 0.31% to close at 1340.43, the NASDAQ Composite rallied 6.02 or 0.21% to 2831.58, and small caps outperformed with the Russell 2000 up 5.65 or 0.68% to 834.02. Breadth was bullish.

It all appears just too easy, doesn't it? The market has been rising steadily since the end of August (only interrupted in November) and rising steadily since the end of November and 230 points off the 'flash crash' bear lows. We all know but few will outwardly admit that this rally is a result of 'financial engineering' by Tim Geithner, Ben Bernanke and other cohorts of the Plunge Protection Team in Washington, D.C. It's plain and simple. Market manipulation on an unprecedented scale fueled by the printing press and near total coverup of all the wrong doings by our financial industry. You can't 'fight the Fed', so enjoy the party and stay long the market until a new bear cycle is confirmed. I cannot tell you whether the party ends this summer, next Spring or a year from Tuesday. All we can is watch the tape and listen to any change of wording coming out of the mouth of Ben Bernanke who is de facto the most powerful man in the world! We may very well see the S&P 500 tra de back in the mid-1500s erasing all the 2007-2008 bear market losses.

All the major indexes closed at new recovery highs. Seven of the nine market sectors hit and/or closed at new highs. Small caps outperformed. All signs are bullish.

Again, we got more dividend hikes (WMB, LEA, KO) and stock buybacks (LEA) yesterday. As long as companies keep doing so, there will be upward pressure on the market. We remain on a TIMER DIGEST Buy Signal and the bull market continues...

The commodity sectors led the advance yesterday (XLB +0.90% and XLE +0.99%). Consumer Staples was the third best sector (XLP +0.68%) after Dr. Pepper Snapple Group announced good earnings Coke raised in dividend. Financials were the only sector to decline (XLF -0.12%) after analysts at Bank of America Merrill Lynch warned that takeover hopes may have left the valuations of regional bank stocks stretched.

DOW TRANSPORTS - ACTION ALERT -

Transportation stocks moved up with the rest of the market yesterday. The Dow Jones Transportation Average gained 12.58 or 0.24% to 5298.10. It posted an end of day recovery high, but did not surpass Wednesday's intra-day high.

Growth in the world's premium-class air traffic, which include business-class and first-class passengers, slowed substantially in December because of severe weather in Europe and the U.S., according to industry data released Thursday. Premium traffic for the month climbed just 2.8% year-over-year, versus a 7.6% jump in December 2009, the International Air Transport Association said. Weather, as well as the sudden surge in demand at the end of 2009, impacted year-ago comparisons. Economy class growth in December slowed to 2.4% from 7% a year ago. "Fourth-quarter aggregates give a better indication of the underlying momentum to international travel markets, with two out of three months unaffected by bad weather," IATA said. "These measures all show solid growth, albeit at a slower pace than at the start of 2010." Airlines (^XAL) fell 0.26%.

GOLD and METALS - ACTION ALERT -

Precious metals rallied yesterday amid higher than expected inflation, a weak Dollar, and increasing turmoil in the Middle East. Gold hit a five week high and silver is again trading at a 30-year high. Gold rose 9.00 to 1384.60. Silver outperformed, gaining 1.10 to 31.78 and hit a new 30-year high of 31.88. I still have an unfulfilled upside intermediate target of 36.00 'on the books'. Platinum rose 2 to 1831. Palladium rose 2 to 840. Copper settled up 0.0140 to 4.4840.

BONDS - ACTION ALERT-

Treasuries rallied yesterday as rising tensions in the Middle East spark a move to safety, but gave up some of its gains after a higher than expected inflation report and as stocks move up. The long bond future gained 16/32 to 119 14/32 but traded as high as 119 25/32 yesterday morning.

The Federal Reserve Bank of New York bought $7.24 billion in Treasury debt on Thursday, part of the Fed's second round of quantitative easing, and includes purchases made under a previous program to reinvest cash from its maturing mortgage-related holdings back into Treasurys. Dealers offered the central bank $23.106 billion in Treasurys maturing from 2018 to 2021. Since the program began in August, the Fed had bought about $412 billion.

The Treasury Department sold $9 billion in 30-year Treasury Inflation Protected Securities on Thursday at a yield of 2.19%. Bidders offered to buy 2.54 times the amount of debt sold, compared to an average of 2.62 times at the government's two sales of the security last year. Indirect bidders, a group that includes foreign central banks, bought 55.2% of the sale, compared to an average of 42.4% of the 2010 sales. Direct bidders, a group that includes domestic money managers, bought 3.6%. Comparisons to last year's sales are difficult because of a change in classification rules.

The Treasury Department said it plans to sell $99 billion in notes and bonds next week. The U.S. government said it will sell $35 billion in 2-year notes, $35 billion in 5-year notes and $29 billion in 7-year notes.

Inflation is too low and may stay below the Fed's target of 2% growth through the end of 2013, said Charles Evans, the president of the Chicago Fed on Thursday. In a speech to the Chamber of Commerce in Rockford, Illinois, Evans said he realized that his outlook on inflation was an "unpopular" viewpoint. He noted that gasoline costs make up only about 3.6% of the Fed's preferred measure of inflation, the personal consumption expenditure index. "In fact, over 80% of what consumers spend their money on increased at an annual rate of 2% or less over the past three months," Evans said. Recent economic data has been encouraging, but it is important to remember that a 4% GDP annual growth rate would be a "relatively muted recovery." "We still have a long road ahead" to return the economy to full employment, he said. Evans is a voting member of the Fed's interest rate setting Federal Open Market Committee this year.

Data over the past two months show that inflation is on the march, said Thomas Hoenig, the president of the Kansas City Fed on Thursday. There are "indications that inflation is rising -- slowly, modestly but still rising," Hoenig said in an interview on the Fox Business Network. Hoenig also said the economy was now on a sustainable growth path. Hoenig voted against the Fed's latest $600 billion bond buying program, arguing that it might foster imbalances like the recent housing bubble. Hoenig suggested rapidly rising prices of farm land might be a new imbalance resulting from easy Fed policy. Hoenig said he would argue against any Fed decision to launch another round of asset purchases. "We have been in a recovery now for over a year and a half and I think we need to keep that in mind as we look ahead," Hoenig said.

CRUDE OIL - ACTION ALERT -

Oil rallied yesterday on news of growing trouble in the Middle East. The weak Dollar also helped. April Crude oil, now the most active contract, rose 1.00 to 88.84. We traded as low as 83.85 (from the 93.02 high)and touched 89.25 intra-day yesterday. It's too early to call for new highs, but I'm watching carefully. New highs would likely trigger panic buying toward 100.

Natural gas fell 0.053 to 3.868 after the EIA said supplies of the energy product dropped 233 billion cubic feet in the week ended Feb. 11. Analysts polled by Platts had expected a decline of 235 to 239 billion cubic feet.

US DOLLAR - ACTION ALERT -

The US Dollar Index fell yesterday as traders worried that rising inflation in the US will eat into their earned interest of Dollar deposits, especially as interest rates have decline recently. Additionally, the turmoil in the Middle East may be hurting the Dollar. The US Dollar Index fell 0.228 to 77.995.

Normally, uncertainty helps the Dollar. But the concern with the protests in the Middle East is that the US may have to get involved militarily or politically. As a result, traders are buying Swiss Francs, seen as an even safer currency than the US in geo-political situations. The Swiss Franc rose 1.01% against the Dollar and 0.72% against the Euro.

ECONOMIC NEWS:

New applications for U.S. unemployment benefits rose last week by 25,000 to 410,000, the Labor Department reported Thursday. Economists had expected initial claims in the week ended Feb. 12 to rise to a seasonally adjusted 400,000 from a revised 385,000 the week before. Continuing claims, which reflect the number of people already receiving unemployment compensation, edged up by 1,000 to a seasonally adjusted 3.91 million in the week ended Feb. 5. About 9.25 million Americans were getting some kind of state or federal benefit in the week ended Jan. 29, down about 108,500 from the prior week.

U.S. consumer prices rose a seasonally adjusted 0.4% in January, the Labor Department reported Thursday, driven by higher food and energy expenses. The core consumer price index, which strips out volatile food and energy costs, rose a lesser 0.2%. Economists had forecast CPI to rise 0.3% overall, with a 0.1% increase in the core rate. Consumer prices are up 1.6% over the last 12 months. In a related report, the government said average hourly earnings fell 0.1% in January, adjusted for inflation. Real average weekly earnings were down 0.3%.

The economy's expansion is expected to continue in coming months, though current conditions, which are slowly improving, remain weak, the Conference Board said Thursday as it reported that its leading economic index rose 0.1% in January. "The economy gained some momentum in late fall, and the latest data suggest that trend will continue," said Ken Goldstein, economist at the Conference Board, in a statement. Six of the 10 indicators included in the LEI made positive contributions in January, led by the interest rate spread. The largest negative contribution came from building permits. Economists had expected the overall index to rise 0.2% in January. In December, the LEI rose 0.8%, compared with the Conference Board's prior estimate of 1%. The LEI is a weighted gauge of 10 indicators that are designed to signal business cycle peaks and troughs. In recent months, there have been widespread strengths among the indicators, according to the Conference Board. For the six months th rough January, the LEI gained 3%, up from 2.2% in the prior six months.

The index of manufacturing activity in the Philadelphia region jumped in February to its highest level since January 2004, the Federal Reserve Bank of Philadelphia reported Thursday. The Philly Fed business condition index rose to 35.9 in February from 19.3 in January. The increase was much stronger than expected. Economists expected the index to tick higher to 20.8.

CORPORATE NEWS:

Apache Corp. said its fourth-quarter earnings grew to $670 million, or $1.77 a share, from $582 million, or $1.72 a share, in the year-ago period. Adjusted earnings rose to $2.19 a share, from $1.96 a share. Revenue increased to $3.43 billion, from $2.56 billion. Analysts expected Apache to earn $2.46 a share, on revenue of $3.46 billion. Apache said the political events in Egypt have not affected its production this year. APA inched up 0.09%.

Duke Energy said its fourth-quarter earnings rose to $427 million, or 32 cents a share, from $346 million, or 26 cents a share, in the year-ago period. Revenue rose to $3.45 billion, from $3.11 billion. Adjusted earnings fell to 21 cents a share, from 28 cents a share, last year. Wall Street analysts expected the power firm to earn 23 cents a share, on revenue of $3.15 billion. Duke Energy expects 2011 profit of $1.35 to $1.40 a share, compared to the analyst expectation of $1.33 a share. DUK rose 2.37%.

CBS said its fourth-quarter profit more than quadrupled against a quarter that included several items a year earlier, as the mass media conglomerate benefited from an industry-wide rebound in advertising sales. CBS said it earned $283 million, or 41 cents a share, compared with a profit of $59 million, or 9 cents a share, in the fourth quarter of 2009. Excluding items in the latest three months, CBS said it would have earned 46 cents a share. Revenue rose to $3.9 billion from $3.5 billion. Analysts were expecting a profit of 43 cents a share on sales of $3.86 billion. CBS gained 1.13%.

Waste Management said its fourth-quarter net income fell to $281 million, or 59 cents a share, from $315 million, or 64 cents a share, in the year-ago period. Revenue rose to $3.19 billion from $3.01 billion. Excluding one-time items, the Houston company said it would have earned 60 cents a share in the most recent quarter. Analysts were looking for earnings of 54 cents a share, on average, with sales of $3.2 billion. For 2011, adjusted earnings are forecast to be in a range of $2.24 to $2.30 a share, versus the Wall Street consensus of $2.25 a share. WM slipped 0.03%.

PG&E said its fourth-quarter net income fell to $250 million, or 63 cents a share, from $273 million, or 71 cents a share, in the year-ago period. Adjusted earnings fell to 70 cents from 80 cents a share. The San Francisco power company attributed its lower adjusted income to increased costs for its smart meter program and its scheduled nuclear refueling outage at the Diablo Canyon plant. Wall Street analysts expected PG&E to earn 72 cents a share. PG&E stuck to its 2011 estimate for adjusted profit of $3.65 to $3.80 a share. PCG fell 0.96%.

NetApp's earnings jumped 60% to $172.5 million, or 42 cents a share, compared with $107.9 million, or 30 cents a share, for the same period the previous year. Adjusted earnings were 52 cents a share and revenue jumped 25% to $1.27 billion. Analysts were expecting earnings of 50 cents a share on revenue of $1.28 billion. NetApp also forecast revenue of $1.38 billion, plus or minus 2%, and Wall Street is looking for $1.37 billion. NetApp said it expects fourth-quarter adjusted earnings to come in between 49 cents to 53 cents a share. Analysts currently expect earnings of 53 cents a share. NTAP declined 6.44%.

Nvidia posted a fiscal fourth-quarter profit of $171.7 million, or 29 cents a share, up from $131.1 million, or 23 cents a share, for the year-earlier period. Revenue at Nvidia fell to $886.4 million from $982.5 million, and adjusted earnings were 23 cents a share. Analysts had expected earnings of 21 cents a share on revenue of $897.7 million. The company also posted a stronger-than-expected sales outlook. NVDA jumped 9.84%.

J.M. Smucker said its fiscal third-quarter earnings fell to $132 million, or $1.11 a share, from $135.5 million, or $1.14 a share, in the year-ago period. Sales rose to $1.31 billion from $1.21 billion. Analysts were looking for earnings of $1.26 a share, on sales of $1.26 billion. For 2011, the Orville, Ohio food company adjusted its full-year profit forecast to a range of $4.60 to $4.65 a share, from a prior view of $4.55 to $4.65 a share. The Wall Street consensus is for a profit of $4.66 a share. Sales for fiscal 2011 are predicted to climb 4% from 2010. SJM rallied 4.22%.

Dr. Pepper Snapple Group said its fourth-quarter earnings declined to $112 million, or 49 cents a share, from $114 million, or 44 cents a share, in the year-ago period. Common shares outstanding fell to 228.5 million in the quarter from 255.5 million last year. Net sales increased 4% to $1.41 billion. On an adjusted basis, the Plano, Texas maker of sugary drinks said it earned 67 cents a share. Analysts were looking for earnings of 63 cents a share, on average. For 2011, Dr. Pepper Snapple forecast earnings in the range of $2.70 to $2.78 a share, versus the Wall Street consensus of $2.72 a share. DPS increased by 5.69%.

Industrial conglomerate SPX reported fourth-quarter net income attributable to common shareholders of $65.3 million, or $1.29 a share, compared to a net loss of $72.1 million, or $1.46 a share, in the same period the previous year. Adjusted net income per share from continuing operations, which excludes a 17-cent tax benefit, was $1.13 a share, matching forecasts. Revenues rose slightly to $1.33 billion from $1.32 billion. SPW dropped 1.41%.

Williams said its board approved separating the company's businesses into two stand-alone units. As part of the plan, Williams will spin off its exploration and production business through a public offering of up to 20% of its interest in the third quarter and then in 2012, spin off the remaining interest. The company also raised its first-quarter dividend by 60% to 20 cents and plans another 10% to 15% dividend increase by June 2012. WMB rallied 8.36%.

Coca-Cola said its board raised the company's quarterly dividend by 7% to 47 cents a share from 44 cents. The dividend will be paid April 1 to shareholders of record on March 15. KO rose 1.81%.

Lear announced a $400 million share repurchase program and initiated a quarterly dividend of 25 cents a share. Separately, the company declared a 2-for-1 stock split. LEA declined 0.24%.

POST-MARKET NEWS:

Nordstrom reported fiscal fourth-quarter net income rose to $232 million, or $1.04 a share, from $172 million, or 77 cents, a year ago. Revenue for the upscale department store chain rose nearly 11% to $2.82 billion from $2.54 billion. Analysts expected the Seattle-based company to earn $1.00 a share on $2.82 billion in revenue. The company said it expects to earn $2.95 to $3.10 a share in fiscal 2011, which is in line with analysts' estimates. Separately, the company said it plans to buy HauteLook, a platform that serves the growing online sales marketplace, for $180 million. Nordstrom shares fell 1.7% to $45.70 in after-hours trade. JWN fell 2.8% in after hours trading.

Intuit posted fiscal second-quarter net income of $73 million, or 23 cents a share, compared to $114 million, or 35 cents a share in the same period a year earlier. The provider of tax-preparation software said revenue for the period ended Jan. 31 rose 5% to $878 million. Intuit said the results reflect the shift of between $40 million and $60 million of tax revenue and operating income to the third quarter from the second, "due to the Internal Revenue Service not accepting certain e-filed tax returns until mid-February." Excluding one-time items, Intuit said earnings for the quarter were 32 cents a share. Analysts had expected Intuit to report earnings for the quarter of 32 cents a share, and $891.8 million in revenue. INTU rose 2.6% in late trading.

Canadian TSX, TSX Venture and Canadian Dollar Commentary for our Canadian clients updated for Friday, February 18:

Rising commodity prices lifted the Canadian market to large gains and new recovery highs. The TSX rose 76.97 or 0.55% to 14136.15. Technical measurements now confirm a move in the TSX (intermediate term) to 15,000 and possibly 15,600 based on my current Leibovit Volume Reversal strategy.

Barrick Gold reported fourth-quarter net income of $896 million, or 90 cents a share, up from $215 million, or 21 cents, earned in the final three months of 2009. Quarterly sales generated by the Toronto-based mining company reached $2.95 billion, up from the prior year's $2.36 billion. Gold production for the latest quarter totaled 1.7 million ounces, in line with management's expectations, on a strong performance in Barrick's North American region. The company also pegged projected production for 2011 in a range of 7.6 million ounces to 8 million ounces, as compared to nearly 7.77 million ounces for 2010 and 7.4 million ounces for 2009. ABX.TO rallied 1.90%.

Agnico-Eagle Mines fell 4.8 percent to C$71.75. The gold producer reported fourth quarter earnings excluding certain items that missed the average analyst estimate by 25 percent, Bloomberg data showed.

Sun Life Financial Inc. retreated 2.6 percent to C$33.02. Canada's third-biggest insurer reported fourth-quarter net income of 88 cents a share, missing the average analyst estimate by 3 percent. The company's shares were downgraded to "hold" from "buy" at Canaccord Genuity Ltd.

CANADIAN TSX Venture:

The Venture did even better than the TSX or US market indexes as gold rallied to a five-week high and silver rose even more to a 30-year high. The TSX Venture gained 22.47 or 0.94% to 2421.89, a new recovery high. Like the TSX, the TSX Venture now projects much higher technically and a move as high as 2575 appears to lay ahead in coming weeks or months.

THE CANADIAN DOLLAR (using the FXC Exchange Traded Fund):

The Canadian Dollar rallied to a new recovery high as commodities rallied, but then gave up most of its gains to finish nearly unchanged as traded weighed the benefit of higher oil and metal prices against potential economic disruption if things in the Middle East get out of hand. FXC finished up 0.03 at 100.97 after trading up to 101.13, its highest level since May 2008.

Resistance is 102.00, 105.00, 110.00. Support is 95.96, 93.20, 92.50 91.82, 91.00, 89.75, 87.50 and 85.18.
